Terms of Use (EULA)

§ 1 Scope

These Terms of Use apply to all contracts between Mario Margarone, Kastanienweg 7, 74417 Gschwend (hereinafter “ASERVIO”) and users of the ASERVIO platform (website and iOS app). Deviating terms of the user are not accepted.

§ 2 Description of services

ASERVIO is operator software for restaurants: table occupancy, reservations, opening hours, menu, and a booking widget for the restaurant’s own website. Guests book with the restaurant, not a consumer dining contract with ASERVIO. The product name is ASERVIO; each shop’s identity lives in that shop’s data.

§ 3 Contract formation and subscription

3.1 Creating an operator account and using a shop creates a user agreement. Paid access is an auto-renewable subscription for that restaurant (not per Apple ID or device). Payment depends on the platform:

• iOS (ASERVIO App Store app): Apple In-App Purchase. Product id app.aservio.monthly (or the id shown at purchase).
• Website: Stripe Checkout / Customer Portal.

The price shown in the purchase flow is binding. App Store prices may be localized (including tax rules of that storefront).

3.2 Continued use of paid features requires an active subscription (Stripe or App Store) or complimentary access we grant. Unpaid shops may be blocked after onboarding.

3.3 Apple subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Payment is charged to the Apple ID. Manage or cancel in iOS Settings → Apple ID → Subscriptions. We do not refund App Store fees; those follow Apple’s terms.

§ 4 Widget and guest bookings

The restaurant is responsible for the widget on its website, for guest communication, and for its own imprint. ASERVIO hosts booking data so the operator can run the floor. A guest reservation is not a contract with ASERVIO for a meal.

§ 5 Duties of the user

You must provide accurate account data, keep login details secret, and only process guest data you are allowed to process. You must not abuse the public booking widget (fake bookings, scraping, overloading).

§ 6 Availability

We aim for high availability but do not guarantee uninterrupted service. Maintenance, network faults, or third-party outages (hosting, payments, push) may interrupt the app.

§ 7 Liability

We are liable without limit for intent and gross negligence, injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for breach of essential duties, limited to typical foreseeable damage. We are not liable for no-shows, kitchen decisions, or the restaurant’s dealings with guests.

§ 8 Termination

You may stop using ASERVIO at any time and request account deletion (see /legal/account-delete). Apple/Stripe subscriptions must be cancelled with the respective provider.

§ 9 Final provisions

German law applies. Place of jurisdiction for merchants is the provider’s seat. If a provision is invalid, the remainder stays in force. The German text of these terms prevails.
